Terms and Conditions effective as of June 5th 2009

1. User agreement
This agreement outlines the terms and conditions under which you use the web site extrahand.com.au.  By becoming a member and/or by accessing or using this service, you agree to be bound by the terms and conditions outlined below.  By agreeing to the set terms and conditions you also hold the responsibility to visit this page on a regular basis to review the terms and conditions and to note any changes made by extrahand.com.au.
You agree that you must be 18+ years old to advertise your services on extrahand.com.au.
Extrahand.com.au is for individual use only and cannot be used for promotion of business services.  When you register as a member you agree that you are advertising your services for your own personal benefit.  Any businesses that advertise their service posing as an individual user will have their subscription terminated.

2. Definitions

  • “Site”- means extrahand.com.au
  • “Member”- includes subscribed users of the site; people advertising their service
  • “Advertiser”- same as “member”
  • “Service provider”- same as “member”
  • “Service”- includes the service that a member provides which includes, but is not limited to, tutors, babysitters, nannies, dog walkers, cleaners, gardeners etc.
  • “User”- includes members of the general public who access the site
  • “You”- same as “user”
  • “Customer”- same as “user”
  • “Information”- includes information on the site and information provided by members
  • “Third Party”- includes individuals, businesses, and other websites who are not affiliated with extrahand.com.au

3. Site membership

i. Becoming a member
You must become a subscribed member in order to advertise your services on extrahand.com.au.  To become a subscribed user you must agree to the terms and conditions, acknowledge the Privacy Policy, and subscribe to extrahand.com.au by purchasing a subscription.

ii. Subscription fee
The subscription fee is to be paid in full upon registering your details with extrahand.com.au.  If payment is not processed then your details will not be uploaded onto the site.  The subscription fee can change without notice, however, the fee stated upon registering your information is the fee that you will be charged.

iii. Member/user conduct
The priority of extrahand.com.au is to offer all members and users a safe and easy to use online directory.  As a member and/or user of this site, you are prohibited from interfering with another member’s and/or user’s experience.  This includes:

  • Using our systems to send unsolicited messages (SPAM)
  • Accessing information not intended for you
  • Attempting to access information not intended for you
  • Disrupting service to extrahand.com.au

Members and users are also prohibited from posting, transmitting, saving, or distributing information or material that is:

  • False, inaccurate or misleading;
  • Fraudulent;
  • Illegal;
  • Defamatory, threatening, or intimidating;
  • Infringes the privacy of another;
  • Obscene;
  • Creates unauthorized link to another website.

iv. Usage of site

Information on extrahand.com.au is accessible by the general public.  Users must understand that any information posted on the site by advertisers is not checked by extrahand.com.au and it is the responsibility of users to check and confirm the information provided by advertisers.


4. Directory only

i. How the site works

Extrahand.com.au is available for the general public and acts as a service directory connecting service providers (advertisers/members) with customers (users).  Customers can search for services in their local area by selecting a service from a drop-down menu and entering a postcode.  Once the search is complete, customers will be provided with a list of service providers that match their search.  Customers are then able to send an enquiry to up to five service providers.  The service providers will then contact the customer if they want to offer the customer their service.

ii. What the site offers

Extrahand.com.au allows people to advertise their services to anyone who accesses the site.  Extrahand.com.au also offers the general public the opportunity to find service providers in their local area.  The aim of extrahand.com.au is to link people who can’t work on a permanent full-time basis but who wish to still work, with people who require services that don’t necessarily require qualifications and/or aren’t readily available.

iii. What the site does not offer

Extrahand.com.au does not undertake the following:

  • Background checks including, but not limited to, police checks, working with children checks, qualifications, and references;

  • Scheduling of any appointments for customers and service providers;

  • Recommending the services of any service providers.

Please understand that it is the responsibility of members to ensure that the information they provide is correct, and the responsibility of users to check the information provided by members.


5. Fees set by service providers

i. Service fee

Service providers have the opportunity to set a fee and/or to negotiate a fee with customers.  It is the responsibility of both parties to agree on a set fee before the service is provided. 

ii. Disputes/concerns

If you have a dispute or concern regarding the fees charged to you as a customer, the service provided to you as a customer, or the fees paid to you as a service provider, then you should direct these concerns to the relevant person.  Extrahand.com.au is unable to intervene in disputes on your behalf or accept any liability.


6. No representation or warranties

i. Services

Extrahand.com.au does not provide any representations or warranties relating to the service provider and/or the service provided.  Extrahand.com.au is a directory service only and it is the responsibility of the customer to undertake any relevant background checks related to service providers.

ii. Concerns

If you have any concerns regarding service providers or customers then it is your responsibility to address your concern.  If there has been a breach of terms and conditions by either party then you can inform extrahand.com.au and we will investigate the matter but we will not act on your behalf regarding any disputes you have.


7. Acceptance of risk and release from liability

i. Members

Members must acknowledge that there are risks involved with dealing with strangers.  These risks include, but are not limited to, physical harm, receiving false information, dealing with people underage, and/or people acting under false pretences.  You assume all risks associated with dealing with other users with whom you come into contact with through extrahand.com.au.

ii. Customers

Users should use their own discretion before engaging the services of any advertisers on the site.  Extrahand.com.au makes no representations about the accuracy of the information provided, their legality, safety or the quality or availability of the services they provide.

iii. Information

Extrahand.com.au will not be held responsible for the information provided by service providers.  Service providers and information posted by them has not been screen or endorsed by extrahand.com.au.  Users should use their own discretion before engaging the services of any advertisers on the site.  Extrahand.com.au makes no representations about the accuracy of the information provided, their legality, safety or the quality or availability of the services they provide.

iv. Site liabilities

You agree that extrahand.com.au shall not be held liable to any user or to any other person, for:

- incidental or consequential losses, damages, or expenses, directly or indirectly arising from any action or omission by another user or by extrahand.com.au;

- Fees paid to service providers;

- Any damages, lost profits, casts or losses arising out of your use of the website.

You agree to indemnify, defend, and hold harmless extrahand.com.au against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this agreement, the use of this site and the use or the inability of use of any information on the site, and your failure to abide by any restriction regarding the use of information on this site.


8. Privacy and security

i. Protection

When subscribing to extrahand.com.au, you will be asked to provide personal information such as your name, telephone number, mailing address, email address and other information pertinent to create an account within our database. This information is held strictly confidential and stored securely. We will use this information only to facilitate your experience with our website, and to contact you if necessary. We will not sell or provide any of this information to organisations that may be interested in making unsolicited contacts, and we will not disclose it to any third party except as may be required by law.

• Billing information

When registering your account, you will be asked to provide billing information. The server that your credit card number and expiration date is collected on uses encryption technology to protect the information while in transit.  This information is not known to extrahand.com.au and is not stored in our database. Please refer to the PayPal website for more information.

ii. Collection

Extrahand.com.au automatically gathers information regarding the usage of this site.  This information is strictly for statistical purposes and includes information like the numbers and frequency of visitors to the site.  This information helps us improve our service to you.  Statistical information may also be provided to advertisers but no personal information will be forwarded to third parties.

iii. Disclosure

Extrahand.com.au do not use or disclose information about your personal and contact information to any third party.

iv. Security

Extrahand.com.au takes all reasonable steps to ensure the security of our systems.  We may use 'cookies' to simplify the user's experience. If you set your browser to reject cookies, the site will not function properly. The extrahand.com.au database resides behind a firewall in order to protect against the loss, misuse and alteration of the information under our control. We have taken preventive measures to restrict access to sensitive data, as well as to detect and prohibit certain connections and operations by unauthorized users. No claim is made as to the impenetrability of the system under unusual circumstance or its resilience to future attacks.


9. Copyright

All material on extrahand.com.au is protected by Australian and international copyright laws.  The material included text, graphics, images, html codes, and any other material on the site.  All material on the site is owned by extrahand.com.au and you may not sell, modify, copy, reproduce, display, upload, distribute or otherwise use this information in any way for any public or commercial purpose.  You may download material from this site for your personal, non-commercial use provided you keep in tact all copyright and other proprietary notices.

You may create a link to this site after first having gained permission in writing from extrahand.com.au.


10. Links to Third Party sites

Extrahand.com.au may contain links to third party sites.  Access to any other internet site linked to this site is at your own risk and extrahand.com.au accepts no responsibility for the accuracy or reliability of any information, data, opinions, advice or statements made on such sites.  Any links made are purely for convenience and/or advertising, and by making links to third party sites does not imply any endorsements made by extrahand.com.au.


11. Termination

Extrahand.com.au may terminate your subscription at any time during the term of your subscription.  Termination may occur if you breach any of the terms and conditions and, if this occurs, you will be notified in writing.  If you wish to terminate your subscription then you can do so by contacting extrahand.com.au.  If termination occurs, either by breach of terms and conditions or because a member wishes to cancel their subscription, no refund will be given.

If a member’s subscription is terminated because they have breached the terms and conditions then resubscribing to extrahand.com.au must be approved by extrahand.com.au prior to payment.  If payment has been made and approval has not been granted then the members risks terminating their subscription without refund.

12. Renewal of 12 month subscription offer terms

Members who have paid for a 12 month subscription will receive an additional three months subscription upon renewing their membership.  Members can renew their membership for either three months, six months, or 12 months to be eligible to receive the additional three months. 

Extrahand.com.au has the right to refuse membership renewal if we deem that the renewing member has breached extrahand.com.au's terms and conditions.

13. Referring 10 friends offer terms

Members can receive an additional three months for every 10 friends that subscribe to extrahand.com.au based on their referral.  Members must contact offers@extrahand.com.au to be eligible for this offer and follow the instructions given by extrahand.com.au.

Extrahand.com.au has the right to refuse this offer to any member who is deemed to be acting in a manner that is not in accordance to the terms and conditions set out by extrahand.com.au.

14. 30 Day guarantee terms

Extrahand.com.au will refund 100% of the subscription fee for anyone who meets the following criteria:

   (i) Has not received a contact within 30 days of the subscription activation date;
   (ii) Has advertised their services in no less than 10 postcodes;
   (iii) Charges an hourly rate that is comparable to similar service providers (eg. an hourly rate must be similar to other service providers in the same field);
   (iv) Makes themselves available at least three times a week;
   (v) Has permanent residency in Australia.

Refunds will be made to anyone who meets the above criteria and contacts support@extrahand.com.au requesting a refund. All requests will be checked and subscribers will be notified shortly after the request has been made.

Anyone who receives a refund will continue to have their details advertised on extrahand.com.au. The subscriber can update their information once they have received a refund, or they can request to have their subscription cancelled.

15. Advertising in South Australia

By law, we are unable to advertise Babysitters and Nannies based in South Australia.  If you advertise as a Nanny and/or a Babysitter we will ask you to select another category in which to provide services for.  No refunds will be given to people who proceed with advertising their services as either a Nanny or Babysitter.
